AIR MILES SXSW Interactive Conference Experience 2017 Official Contest Rules

The Contest is open only to Canadian resident AIR MILES® Collectors (individually a “Collector” and collectively “Collectors”) who are 19 years of age or older and are otherwise eligible in accordance with the requirements set out in Rule 1 below (a “contestant”).

NO PURCHASE IS NECESSARY TO ENTER THE CONTEST.

How to Become an AIR MILES® Collector

If you are not already an AIR MILES Collector you may become one by enrolling online at www.airmiles.ca.

General

The Contest is sponsored and administered by Notable Media Inc. (the “Contest Sponsor”). In these Rules, the term “Sponsor” includes, where the context permits or requires, any representative or representatives of the Sponsor.  Any questions, comments or complaints regarding the Contest should be directed to the Contest Sponsor at 476 Richmond Street West (Suite 100) Toronto, ON.  By participating in this Contest, each contestant agrees to be legally bound by these Rules.

LoyaltyOne, Co. (the “Prize Provider”) is not in any way connected with the management of this Contest.

1. ELIGIBILITY:

The Contest is open only to any Canadian resident AIR MILES® Collector who is 19 years of age or older at the time of entry (an “Entry”) into the contest, except directors, officers, employees, representatives and agents of the Contest Sponsor, its affiliates and its respective advertising and marketing agencies and persons domiciled with any of the above. The Collector is the individual in whose name the Collector Number has been established under or, in the case of a Business Collector, the principal associated with the Business Collector Number, as determined in its sole discretion by the Contest Sponsor. Canadian residence will be determined by the mailing address associated with the Collector Number.

Note:  Online access and an email account is required to participate in this Contest. Many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free email accounts.

2. AGREEMENT TO THE RULES:

By participating in the Contest, a contestant fully and unconditionally agrees to and accepts in full the Official Contest Rules and the decisions of the Contest Sponsor, which decisions are final and binding in all matters related to the Contest.

3. CONTEST PERIOD:

The Contest begins at 12:01 a.m. on October 17, 2016 and ends 11:59 a.m. on November 14, 2016 (the “Contest Period”)All times refer to the applicable (standard or daylight saving) Eastern Time (“ET”) throughout the Contest.

4. HOW TO ENTER THE CONTEST:

There are (4) ways to enter this Contest during the Contest Period, as described below.  There is no limit on the number of Entries which are recorded on behalf of a Collector.

1) For new and existing Collectors

During the Contest Period, a contestant should go to www.notable.ca and search for Article #1 entitled Why You Should Never Leave Your House Without an AIR MILES Reward Miles Card”.  Article #1 will be available on the www.notable.ca  website on October 17, 2016.  Then fill out and submit the Contest entry form which appears in that article.  When a contestant has done that, one Entry will be recorded in the name of the contestant who is associated with the Collector Number used to complete the Entry.

2) Opt-in or already be opted-in to receive email communication from AIR MILES:

During the Contest Period, a contestant should opt-in to receive email communications from AIR MILES and then he/she simply can go to www.notable.ca and search for on Article #2 titled We Want to Send You to One of the Hottest Destinations of 2017”.   This Article #2 will be available on the www.notable.ca  website on October 24, 2016.  If a contestant already has opted-in to receive email communications from AIR MILES then he/she simply can go to www.notable.ca and search for on Article #2 just described.  Then fill out and submit the Contest entry form which appears in that article.  When a contestant has done that, one Entry will be recorded in the name of the contestant who is associated with the Collector Number used to complete the Entry.

Note:  A Contestant may opt-out of email communications from AIR MILES communications at any time without losing his/her Entry into the Contest provided that the Contest entry steps described in this Rule 4 2) have been completed in their entirety.

3) AIR MILES Cash Preference for new and existing Collectors:

During the Contest Period, a contestant should sign into his/her AIR MILES Account and set his/her AIR MILES profile settings either to “partially” or “entirely” AIR MILES Cash where the contestant can use AIR MILES Cash towards in-store or online purchases at https://www.airmiles.ca/arrow/EarnRatio.  Then the contestant should go to www.notable.ca and search for Article #3 entitled Here’s How You Can Use Your AIR MILES to Make the World a Better Place”. This Article #3 will be available on the www.notable.ca  website on October 31, 2016.  Then fill out and submit the Contest entry form which appears in that article.  When a contestant has done that, one Entry will be recorded in the name of the contestant who is associated with the Collector Number used to complete the Entry.

During the Contest Period, if a contestant already has set his/her AIR MILES preference settings either to “partially” or “entirely” Cash Rewards, then he/she simply can go to www.notable.ca and search for Article #3 entitled Here’s How You Can Use Your AIR MILES to Make the World a Better Place”. This Article #3 will be available on the www.notable.ca  website on October 31, 2016.  Then fill out and submit the Contest entry form which appears in that article.  When a contestant has done that, one Entry will be recorded in the name of the contestant who is associated with the Collector Number used to complete the Entry.

4) Download and login to the AIR MILES Mobile app:

During the Contest Period, a contestant should download the AIR MILES Mobile app into his/her mobile device and then login to the AIR MILES Mobile app using his/her Collector Number.   If a contestant already has the AIR MILES Mobile app downloaded into his/her mobile device, he/she should login to the app.  Then he/she simply can go to www.notable.ca and search for on Article #4 titled SXSW is the Hottest Ticket for Spring 2017 – And We’re Giving it Away.  This Article #4 will be available on the www.notable.ca  website on November 7, 2016.  Then fill out and submit the Contest entry form which appears in that article.  When a contestant has done that, one Entry will be recorded in the name of the contestant who is associated with the Collector Number used to complete the Entry.

A NO PURCHASE NECESSARY METHOD OF ENTRY.

5. PRIZE: 

There is one (1) Prize available to be won in the Contest. The Prize consists of the following elements:

A) Two roundtrip, economy class airfares, for the verified winner (the “Winner”) of the Prize and one (1) guest, departing from the major Canadian airport closest to the Winner’s residence in Canada (as determined by the Contest Sponsor in its sole discretion) to Austin–Bergstrom International Airport in Austin, Texas on March 9, 2017 and returning on March 15, 2017;

i. Return car service transportation for Winner and one (1) guest from Austin–Bergstrom International Airport to the hotel;

ii. Six (6) nights’ accommodation (double occupancy) at Sheraton Austin Hotel at the Capitol, 701 East 11th St, Austin, TX 78701;

iii. Two (2) Interactive Badges – ONE (1) each for the Winner and one (1) guest – allowing admission to the South by South West Marketing and Business Conference (“SXSW Conference”) taking place in Austin, Texas, U.S.A. from March 10 – March 15, 2017. The SXSW Interactive Badge gives access to the following:

a. 5-day primary entry to all SXSW Conference Interactive and Convergence Tracks, Interactive and Comedy Festivals, and Exhibitions and secondary access to a majority (as determined by the Sponsor in its sole discretion) of Film and Music programming between March 10 – March 14, 2017, and

b. the SXSW Gaming Expo and Awards, SXSW Create, SXSW Job Market, Flatstock Poster Show, Registrants Lounge, Spotlights, The Dewey Winburne Community Service Awards event, SouthBites Trailer Park, and SXSW Outdoor Stage at Lady Bird Lake Concerts. Winner and guest will also receive SXSW Materials: Registrant Big Bag, Program, Pocket Guide & Subscription to SXSWord®.

The total approximate retail value of the Prize is $5,300 CAD, based on a departure from the City of Toronto, ON and a destination of Austin, TX. However, the actual value will vary depending on the actual point of departure.  Any difference between the stated approximate value and actual value cannot be claimed by and will not be awarded to the Winner.

The Prize is subject to certain restrictions as follows:

B) All travel related to the Prize must be completed between March 9, 2017 and March 15, 2017 or the Prize will, in the sole and absolute discretion of the Contest Sponsor, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place;

C) The confirmed Winner’s guest must be a Canadian resident who is 19 years of age or older;

ii. the Prize must be accepted as awarded and is not transferable, assignable and/or convertible to cash (except as may be specifically permitted by Contest Sponsor in its sole and absolute discretion);

iii. no substitutions, except at the Contest Sponsor’s option;

iv. the confirmed Winner and his/her guest must: (a) travel on same itinerary; (b) have or obtain, at Winner and guest’s sole expense, all necessary documentation to permit travel to the United States, including as applicable a current passport [which must be valid on the day of departure and for a period of six (6) months thereafter] and (c) must not have any legal barrier to travel to Austin, Texas, U.S.A.;

v. the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the confirmed Winner and his/her guest, including, without limitation: transportation for the confirmed Winner and his/her guest to and from the Canadian departure airport, excess baggage and other fees, travel insurance, meals and all alcoholic and non-alcoholic beverages, souvenirs, and items of a personal nature (NOTE: the confirmed Winner (or his/her guest) may be required to present a valid major credit card in his/her name at the time of hotel check-in to cover any expenses which are not expressly included in the Prize);

vi. if the confirmed Winner and/or his/her guest do not utilize any part(s) of the Prize, then any such part(s) not utilized will, in the sole and absolute discretion of the Contest Sponsor, be forfeited in their entirety and, if forfeited, no payment, or anything else will be substituted in their place;

vii. the Contest Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at the Contest Sponsor’s sole discretion, a cash award;

viii. all travel arrangements relating to the Prize must be made in the manner described below;

ix. by accepting the Prize, the confirmed Winner agrees to waive all recourse against the Contest Sponsor and Prize Provider relating to his/her participation in the Prize or if the Prize or a component thereof does not prove satisfactory, either in whole or in part;

x. neither the Contest Sponsor nor the Prize Provider will replace any lost or stolen badges, tickets or other items related to the Prize or any events involved in the Prize;

xi. by accepting the Prize, Winner must sign and deliver to the Sponsor, in the manner and at the time required by the Sponsor in its sole discretion, a form (the “Prize Acknowledgement and Release Form”) which contains, among other things, a declaration of compliance with these Official Rules and a liability and publicity release, in a form prepared by the Sponsor, declaring that the Winner accepts the Prize as awarded, has complied in full with all of the provisions of these Official Rules, is an eligible person, releases the Sponsor and Prize Provider respective directors, officers, shareholders, and employees and the and Sponsor’s and Prize Provider’s franchisees, dealers, affiliates, subsidiaries, divisions, parents and advertising or promotional agencies (and the directors, officers and employees of those franchisees, dealers, affiliates, subsidiaries, divisions, parents and advertising or promotional agencies) from any loss, cost, damage or harm of any nature whatever, including property damage and personal injury or death, incurred through entry into the Contest, participating in the Contest or in the travel and event(s) which forms part of the Prize, by or in connection with the receipt, use or misuse of any part of the Prize and granting to the Sponsor in perpetuity and without geographic limitation, the right (but not the obligation) to use, broadcast, publish and/or disseminate the Grand Prize winner’s name, address (city/town and Province/Territory), photograph, likeness, voice, comments and/or statements in connection with any promotion, publicity or information in connection with the Contest, or in connection with any advertising and publicity carried out by or on behalf of the Contest Sponsor in relation to the Contest or the AIR MILES Reward Program  or for any other publicity purposes in any medium of any nature whatsoever whether now known or hereafter developed (including the Internet) without further notice, review, approval or compensation.

xii. The Contest Sponsor reserve the right, in their sole discretion, to refuse admission and/or to expel from the Conference and/or any other aspect of the Prize, any person whose conduct is deemed by them to be objectionable. Expulsion from the Conference cancels the tickets for the offending individual(s) and the individual(s) thereupon forfeit(s) all claims with respect to the tickets;

xiii. all characteristics and features of the Prize (and of each Prize element), except as otherwise explicitly stated above, are at the Contest Sponsor’s sole and absolute discretion;

xiv. precise travel arrangements are subject to space and flight availability and shall be made at the Contest Sponsor’s sole and absolute discretion;

xv. once booked, travel arrangements may not be changed by the Prize Winner or his/her guest;

xvi. certain blackout dates and further restrictions may apply;

xvii. the Contest Sponsor and Prize Provider will in no way be responsible or liable in the event that any part of the Prize is delayed, cancelled, postponed or rescheduled for any reason whatsoever;

xviii. in the event that the confirmed Prize Winner resides within two hundred kilometers (200 km) of SXSW Conference grounds (as determined by the Contest Sponsor in its sole and absolute discretion), the Airfare will be substituted with limousine ground transportation (as selected by the Contest Sponsor in its sole and absolute discretion).

Travel arrangements must be made by LoyaltyOne Travel Services Co./Voyages LoyaltyOne Co., 416-552-2050, (Ont. license # 4071361, Que. license # 701299, B.C. license # 3308).

6. CHANCES OF WINNING: 

The chance of winning the Prize will depend on the total number of eligible entries received during the Contest Period.

7. WINNER SELECTION: 

A random computerized drawing for the Prize will be held at 2:00 p.m. on November 16, 2016 from among all eligible Entries received during the Contest Period, by the Contest Sponsor whose decisions will be final and binding. In order to be declared a winner, the contestant whose Entry is selected must be eligible to enter the Contest and must first correctly answer, unaided, a time-limited mathematical skill-testing question to be administered to him/her by the Sponsor at a pre-arranged mutually convenient time by telephone and otherwise comply with these Official Contest Rules. The Contest Sponsor or its representatives will make reasonable attempts to contact the applicable contestant at the e-mail address and/or telephone number(s) recorded in respect of his/her Entry.  If the applicable contestant cannot be contacted or has not responded within four (4) days of the date when contact was first attempted, is not eligible in accordance with these Official Contest Rules, does not correctly answer the mathematical skill-testing question or otherwise comply with these Official Contest Rules, then the selected contestant will be disqualified and his/her Entry discarded, will forfeit the Prize to which he/she may otherwise have been or have become entitled and will have no claim against the Contest Sponsor or any other person, firm or corporation in respect of the Contest or the Prize, and another Entry will be selected through a further random computerized draw and the contact process just described will take place with respect to the contestant associated with that Entry.  This process will continue until a contestant whose Entry is selected correctly answers the skill-testing question.

The contestant who correctly answers the skill-testing question will be the potential winner of the Prize.  The Sponsor then will email to that contestant the Prize Acknowledgement and Release Form.  The applicable contestant must print out that form and then execute it fully, and in ink, and then mail it to the Sponsor, for actual receipt by the Sponsor no later than fourteen (14) days of the date of the email to the contestant.  The Sponsor strongly recommends that the contestant use registered Canadian mail, and at his/her own expense postal insurance for that mailing.  Provided the Sponsor actually receives the completed original Prize Acknowledgement and Release Form by that deadline, and that form is in proper order, the potential winner of the Prize will be declared the verified winner of the Prize.

If the Sponsor does not actually receive the completed original Prize Acknowledgement and Release Form by that deadline, or if the Prize Acknowledgement and Release Form is not in order in the sole opinion of the Sponsor, then the selected contestant will be disqualified and his/her Entry discarded, will forfeit the Prize to which he/she may otherwise have been or have become entitled and will have no claim against the Contest Sponsor or any other person, firm or corporation in respect of the Contest or the Prize.  In such case, another potential winner will be identified by the Sponsor through the process of a further random computerized draw and contact process as described above in this Rule 7.

This process will continue until a contestant whose Entry is selected has fulfilled all of the requirements as set out in this Rule 7 and becomes the verified winner of the Prize.

The two interactive SXSW badges portion of the prize can be picked up at the conference registration by the winner and their guest.

8. GENERAL:

The first name or initials and city name of Winner may be posted on www.airmiles.ca and Winner expressly consents to such posting, without any compensation, review or approval.

For Québec residents, any litigation respecting the conduct or organization of a publicity contest in Québec may be submitted to the Régie des alcools, des courses et des jeux (the “Régie”) for a ruling. For Québec residents, any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

Subject to the jurisdiction in Québec of the Régie, the Contest Sponsor reserves the right, at its sole discretion, to substitute a prize with one of equal or greater value, to cancel, terminate or suspend the Contest and/or to amend the Contest without prior notice at any time and for any reason including without limitation, if viruses, bugs, unauthorized human intervention, attempts to disrupt the Contest or other causes beyond the Contest Sponsor’s control corrupt or affect the administration, security, fairness or proper play or conduct of the Contest.

9. LIABILITY DISCLAIMERS:

The Contest Sponsor is not responsible for any technical, hardware, software or telephone failures of any kind, or lost or unavailable network connections or garbled or deleted computer network transmissions, or failed, incomplete, garbled, misdirected or lost entries or inaccurate capture of entry information, even if it/they limit or limits the ability of any contestant to participate in the Contest. Any entry that occurs after a system failure is deemed a defective entry and is void and will not be honored. The Contest Sponsor and Prize Provider are not responsible for any injury or damage which may be caused, directly or indirectly, in whole or in part, from accessing or transmitting any material from the Website (www.notable.ca) regardless of whether the material was prepared by the Contest Sponsor or a third party or is connected to the Website [www.notable.ca] by hyperlink. All entries must be received during the Contest Period and in accordance with all requirements of these Rules. All entries and Prize claims are subject to verification by the Contest Sponsor and will be void if not obtained by legitimate channels, or if not original, or if obtained other than in compliance with these Rules. Proof of sending any portion of an entry or claim is not proof of receipt. All entries become the property of the Contest Sponsor and will not be returned.

Online entries must be made only by the original, manual keystrokes of the individual contestant. Use of any automated system including robotic or form filling software to enter or participate is prohibited and will result in disqualification of all entries by anyone using such assistance.

The Contest Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Contest Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Contest Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Contest Sponsor’s failure to enforce any term of these Official Contest Rules shall not constitute a waiver of that provision.

10. PRIVACY CONSENT:

By entering this Contest, each contestant expressly consents to the Contest Sponsor, its agents and/or representatives, storing and using the personal information submitted with his/her entry only for the purpose of administering the Contest in accordance with these Official Contest Rules and the Contest Sponsor’s privacy policy (available at http://www.airmiles.ca/arrow/PrivacyPolicy) as well as (https://notablelife.com/privacy-policy/). This section does not limit any other consent(s) that an individual may provide the Contest Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

11. GOVERNING LAW

All issues and questions concerning the construction, validity, interpretation and enforceability of these

Official Rules or the rights and obligations as between one or more eligible contestants and the Sponsor in connection with the Contest shall be governed by and construed and interpreted in accordance with the federal laws of Canada, and in accordance with the internal laws of the Province of Ontario, Canada, including the procedural provisions of those Ontario laws, without giving effect to any choice of law or conflict of law rules or provisions that would cause or bring about the application of any other jurisdiction’s laws. All eligible contestants, the Sponsor and all other parties hereby attorn to the jurisdiction of the Courts of the Province of Ontario, sitting in the City of Toronto, Ontario, in respect of the determination of any matter or dispute arising under or in respect of the Contest or these Official Rules and agree that any such determination shall be brought solely and exclusively before such courts in the Province of Ontario.

The name of the winner may be obtained by sending a request with a self-addressed postage stamped envelope to “AIR MILES® SXSW Conference Interactive Experience 2017” Attention: AIR MILES Promotions, 438 University Avenue, Suite 600, Toronto, Ontario, M5G 2L1 until December 29, 2017. The first name or initials and city name of Winner may also be posted on www.airmiles.ca.
