Ontario Finally Strikes Down Law That Forces Same-Sex Couples to Adopt Their Own Kids

Under new (overdue) legislation, same-sex couples in Ontario will no longer have to adopt their own children.

Thanks to the new legislation introduced yesterday, same-sex parents in Ontario who aren’t biologically related to their children have the same legal rights as heterosexual moms and dads.

The All Families Are Equal Act today updates a parentage law that hasn’t been changed since 1978.

The new ruling means that same-sex parents can register births in the same way as male-female couples.

This also means that parents who are not legally considered as such won’t have to live in fear that they can’t make important decisions about their children if a spouse becomes incapacitated.

The legislation is expected to pass by the holidays and take effect in January.

It’s been 10 years since the Ontario Superior Court ruled that couples who use sperm donors and other reproductive technologies should enjoy the same parental rights as those who conceive naturally.

The new legislation eliminates the dollars and the time spent on legal fees and paperwork associated with the adoption process, enabling parents to instead direct that energy to their baby instead.
