2015 Notable Awards Rules and Regulations

2015 Notable Awards (the “Awards Competition”)
Official Rules (the “Official Rules”)

Notable Media Inc. (“Notable.ca”) is the presenting sponsor of the Awards Competition.

1. In these Official Rules, a person who is eligible to nominate a person for entry into the Awards Competition is called an “Eligible Nominator”, and a person who is eligible to be nominated for entry into the Awards Competition is called an “Eligible Nominee”. To be an Eligible Nominee, a person must be a ‘young professional’, legal resident in Canada, who is between the ages of twenty-one (21) and forty(40) as of December 8, 2015 and must have a valid email address. To be an Eligible Nominator, a person must have a valid email address.

2. If you are an Eligible Nominator and wish to nominate a person for entry in the Awards Competition, go to the Awards Competition’s website www.notable.ca/awards (the “Website”) and, if you are nominating yourself, click the “Nominate Yourself” box. Then, complete in full and submit online the nomination form (the “Nomination Form”) no later than December 21 2015 at 11:59 p.m.Toronto time (the “Nomination Closing Date”). Note: Notable Media Inc assumes no responsibility for nominations being made by Nominator’s without consent from the person they are nominating.

3. There are thirty two (32) entry categories (each, a “Category”, and collectively, “Categories”) in the Awards Competition.

4. Indicate on the Nomination Form the Category/Categories for which you are nominating the Eligible Nominee. While you may nominate more than one Eligible Nominee for entry into the Awards Competition, you may not request that a particular Eligible Nominee be entered in more than three (3) Categories in the Awards Competition.

5. It is planned that, after the Nomination Closing Date, a team (the “Preliminary Nominating Team”) appointed in its discretion by Notable.ca will review all Nomination Forms received by the Nomination Closing Date and will identify as Final Nominees (each, a “Category Final Nominee”) in each of the Awards Competition’s Categories. In determining who will be identified as a Final Nominee, the Preliminary Nominating Team will consider the following factors in relation to each Eligible Nominee in a Category: his/her a) apparent dedication to career and professional/personal development, b) apparent involvement in and contribution to charity and community support, and c) apparent inspiration afforded to co-workers, employers, and community. The Preliminary Nominating Team has the discretion to assign whatever weight it chooses to each of the factors just described.

6. The Category Official Nominees will have their profiles posted, by Category, on the Website for public review and voting commencing December 23 2015 at 10:00 a.m. Toronto time and ending January 15, 2016 at 10 a.m. Toronto time (the “Voting Closing Date”).

7. It is planned that, after the Voting Closing Date, the Judging Team, a team (the “Judging Team”) appointed in its discretion by Notable.ca will consider each of the Category Official Nominees in each of the Categories and will identify two (2) to twelve (12) Regional Finalists, in each Category, per region, whom the Judging Team, in its discretion, considers to be the best Regional Finalists (each, a “Potential Winner”) in each Category. The Judging Team will consider the following factors in relation to each Eligible Nominee in a Category: his/her a) apparent dedication to career and professional/personal development, b) apparent involvement in and contribution to charity and community support, and c) apparent inspiration afforded to co-workers, employers, and community and d) amount of online votes. The Judging Team has the discretion to assign whatever weight it chooses to each of the factors just described.

8. Notable will than announce the Category Finalist Per Region.

9. The Category Finalists Per Region will have their profiles posted, by Category, on the Website for public review and voting commencing January 20, 2016 at 10:00 a.m. Toronto time and ending February 10, 2016 at 10.00 a.m. Toronto time (the “Voting Closing Date”).

10. The Regional Winners will have their profiles as well as Microsoft Collaboration and Productivity Index posted, by Category, on the Website for public viewing until the Award Ceremony on February 17, 2016.

11. It is planned that the Judging Team, will consider each of the Regional Winners and choose, in its discretion, the best National Winner in each Category. The Judging Team will consider the following factors in relation to each Eligible Nominee in a Category: his/her a) apparent dedication to career and professional/personal development, b) apparent involvement in and contribution to charity and community support, and c) apparent inspiration afforded to co-workers, employers, and community and d) professional references not made public but made available to Judging Team. The Judging Team has the discretion to assign whatever weight it chooses to each of the factors just described.

12. Note: No Eligible Nominee may be the Notable Young Professional of the Year in more than one Category.

13. Any Nomination Form which is incomplete, irregular, has been submitted contrary in any way to any provision of these Official Rules, or does not conform to or satisfy any condition contained in these Official Rules may be disqualified by Notable.ca. Notable.ca or any employee or officer of Notable Media Inc, takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. Notable.ca is not responsible for any errors or omissions in printing or advertising this Awards Competition.

14. Notable.ca may, in its sole discretion, choose to use, in whole or in part, any photo or written submission entered into the Awards Competition for any lawful purpose including, without limitation, in and for its own future advertising, editorial and/or promotional activities and/or purposes, without any prior notice, review, approval or compensation; and by submitting any such material into the Awards Competition, the applicable person thereby assigns to Notable.ca all his/her right, title and interest (including, without limitation, any intellectual or other property interest) in and to that material. Notable Media Inc or any employee or officer of Notable Media Inc assumes no responsibility for any damages whatsoever.

15. Defamatory, nude, pornographic, racist, sexist, or any other type of photo or written text or both which Notable.ca considers in its sole discretion to be offensive will not be accepted into the Awards Competition.

16. By participating in the Awards Competition, each Eligible Nominator and each Eligible Nominee (collectively, the “Releasors”) hereby releases, holds harmless and agrees to indemnify all members of the Preliminary Judging Team and the Final Judging Team, Officers of Notable Media Inc and employees of Notable.ca, its affiliates and its directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively, the “Releases”) from and against any and all claims, losses or demands which any one of more of the Releasors has or may have against any one of more of the Releases in connection with the Awards Competition or any aspect of the Awards Competition including, without limitation, any claim related to the judging in the Awards Competition and the awarding, use or misuse of any prize or award in the Awards Competition and from and against any and all claims which may be made against any one or more of the Releases by any person, firm or corporation by reason of a Releasor receiving, or using or misusing any prize or award or travelling to receive any such prize or award.

17. All decisions of the Preliminary Judging Team and the Final Judging Team, Notable Media Inc, and of Notable.ca in relation to any matter involved in the Awards Competition shall be final and binding, without discussion or dispute, upon all persons, including without limitation, any Eligible Nominator and any Eligible Nominee.

18. By participating in the Awards Competition, each Eligible Nominee agrees that if he/she is named the Notable Awards Winner of the Year for his/her Category, and if Notable.ca decides, in its sole discretion, to hold any presentation or award ceremony or event, the applicable Eligible Nominee will cooperate fully with Notable.ca in that regard.

19. If Notable.ca so elects, a Potential Winner may be required to submit to, and by entering the Awards Competition, agrees to fully cooperate with Notable.ca in conducting, a confidential background check to confirm that Potential Winner’s eligibility and compliance with the provisions of these Official Rules and to help ensure that the use of such Potential Winner in advertising or publicity for the Awards Competition or otherwise will not bring Notable.ca into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Awards Competition or on Notable.ca, as determined by Notable.ca in its sole discretion.

20. Notable.ca is not responsible to any person for any technical difficulties which arise in relation to the Website or the nomination process or the voting process in the course of the Awards Competition including, without limitation, the incomplete capture or failure to capture any information on or related to or through the Website.

21. In the course of conducting the Awards Competition, Notable.ca will acquire certain personal information as submitted by Eligible Nominators and Eligible Nominees in connection with the Awards Competition. Subject to the provisions of these Official Rules, Notable.ca will use that personal information only for the purpose of conducting and administering the Awards Competition and email communication, if opted in.

22. Notable.ca reserves the right in its sole discretion to remove any Eligible Nominee or Eligible Nominator from participating in the Awards Competition, at any time, and without notice, or explanation.
